According to the reports, the Mapusa court has convicted three persons, Francis D’Souza alias Mirand of Merces, Prasad Kubal of Vasco and Sachin Padgaonkar of St Cruz was sentenced for attempting to murder Zenito. All three had been charged under Sec 307 of the IPC and other sections for rioting at Siridao beach on May 10, 2009, in which two persons had died.

It may be recalled that on 10th May 2009, three families had come for a picnic. While two families were at Bambolim, one was at Siridao. Between 4 and 4.30 pm, Zenito got a call from his cousin Judas to pick up his family from Siridao. Accordingly, he came to the picnic spot along with Mahavir and Dominic to pick up Judas’s family at Siridao.

When Zenito reaches the picnic spot he was called by the Mirand and his group to join them who later started misbehaving with Zenito. “They started asking, ‘You are a goon? Who do you think we are?’ and when my brother objected, they started attacking him with glass bottles and knives,” told Cynthia, sister of Zenito, to the police.

Taking all the charges against Zenito in the account and later looking into the submissions of prosecution and defense lawyers the court had pronounced its judgment on 28th July in which it has discharged Zenito from the charges of murder and held him guilty of Culpable Homicide not amounting to the murder.

While discharging Zenito from the charges of murder the court observed that the murder was not pre-planned and it happened due to instant fight. Because Zenito was also injured in the fight, the court has taken a lenient view. The court has also acquitted co-accused Mahavir Nadar and Dominic Nazareth from all the charges.

Agassaim police had booked both the groups in 2009, wherein the Zenito was booked for the murder of two persons and Mirand group was booked for attempting to murder Zenito as he was seriously injured in the fight. According to the sources, the case was investigated by PSI Sunil Gudlar who is presently under suspension.

With the conviction of another group into this case, the case apparently had come to an end keeping the options open for both the parties to file an appeal at the higher courts. According to the information available from the sources, Zenito had got the order of sentence stayed in the high court, but no relevant documents are available to support this claims at the movement. If anyone wishes to provide the comments and suggestions on this please go ahead.
