The term rape is very wide and complicated in the criminal law. In most of the cases, it is the forcible sexual activity performed on the victim without her or his consent. The term rape is also applicable for the consensual sex that involves the minor girl under the age of 16. These are two distinct examples of the rape. Both the cases are termed as rape for two different nature. First is obviously an incest, which involves a 7-year-old girl that had been raped by her own uncle, which is the case of a custodial rape and it is the most severe crime while the second case involves a 15-year-old girl who was allegedly raped by her boyfriend. According to the law, any boy getting engaged into the sexual activity with the girl who is minor, regardless of her consent, the act of sexual intercourse is considered to be a rape. Both the cases here are very distinct but falls into the single category of rape.
Based on the information available from the reliable sources, In two separate incidents, two minor girls were raped in the south Goa on Tuesday and Wednesday. Maina-Curtorim police have arrested the two accused in the charges of rape and lodged them into the police custody. The first case is a seven-year-old girl who was raped by her own uncle while in the second case involves a 15-year-old girl who was allegedly raped by her boyfriend, said police.
According to Maina-Curtorim police, the seven-year-old girl was raped by her uncle at her residence is a school dropout. Police said that no one was at home on February 22 when the said incident took place. Police informed that the victim’s mother had taken her son for vaccination in a nearby area when the accused entered their house and raped the girl between 11 am to 11.30 am. Police said that based on the complaint lodged at the police station and PSI Alvito Rodrigues registered a case and arrested the accused.
In the second case reported in a village of Salcete, Maina-Curtorim police have arrested one Ajay Tankaker, a young boy. He was working in a hotel, said police. According to the police, he was arrested and lodged in police custody. According to Maina-Curtorim police, the 15-year-old minor girl was raped on a beach in the coastal belt of Salcete. Police said that she was studying in Class IX and was friendly with the accused.
The police investigations revealed that the accused boy took the victim girl on his scooter to the coastal belt on February 21 and raped her. The accused is from Rumdamol-Davorlim. Based on the complaint, police conducted an investigation and arrested the accused Ajay. Meanwhile, the police had sent the accused and victims for the medical examination at GMC (Goa Medical College and Hospitals) at Bambolim and their reports are awaited.
However, both the cases here have been termed as a rape but both the cases are different here. In the first case there is a minor who is just a kid and she was raped by her uncle who is supposed to be her guardian and the girl was in his custody while he exploited her. However the second case is a love affair as mentioned by the sources, the 15-year-old victim girl and the accused youth were in love. According to the law, both the cases will be tried for the same crime and that is rape, under section 375, 376 and the punishment also remains similar in both the case while these two cases.
