A TEAM OF MUMBAI POLICE CAME DOWN TO GOA, TO ARREST A MAPUSA BASED BUSINESSMAN WITHOUT AN ARREST WARRANT. THEY CALLED HIM TO MEET THEM IN A CITY HOTEL IN MAPUSA, AND THEY DEMANDED FIVE LAKH RUPEES FROM HIM TO HUSH UP THE MATTER. BUT WHEN HE DENIED TO SUCCUMB TO THEIR DEMAND, WHATEVER MUMBAI POLICE DID NEXT WAS MOST THE SHOCKING….

Harassment by police to extort money is not the new story in our country, and the matter becomes harsher when the involvement of the different state’s police is concerned. Something similar seems to have happened in this case too.

According to the sources, a local businessman from Mapusa was summoned by the Mumbai police for a meeting in a city Hotel in Mapusa to just negotiate his arrest in return for a cash and when he denied they started his harassment.

The businessman told the media that, the news of Mumbai police arresting him and taking him to Mumbai if false. According to him, it was a false propagation by the media earlier, and that, the police did not take him to Mumbai but he himself went to Mumbai with the interim bail papers.

According to the story narrated by a Goan businessman Gitesh Walke, who deals in a liquor having a shop in Mapusa, the Mumbai police tried to extort 5 lakh rupees from him to relieve him from the (false) case. Gitesh told the local TV channel that he had been implicated falsely in the case, and police wanted to take an advantage of the situation to extort the money from him.

APPLICATION FOR BAIL IN COURT JMFC MAPUSA

When Mumbai Police officers summoned him to the Hotel in a Mapusa, instead of calling him to the police station, he smelt a rat, and took his cousin brother along with him for the meeting, said Walke. According to him, they demanded rupees five lakh from him to hush up the matter but he denied to oblige with the same saying that he has done nothing wrong.

According to Gitesh, the Mumbai police tried every possible way to pressurize him to extort the money from him, but he did not succumb to their pressure. Finally, they took him to the Mapusa police station and officially arrested him despite not having any arrest warrant with them. “They just wanted to extort the money from me. When I said no to it, they played their card and took me to Mapusa police station and made my arrest,” he told the media.

According to the sources, following the arrest of Walke by Mumbai police, he filed for the bail before the Mapusa court and JMFC granted him an interim bail asking him to get the regular bail from the court in Mumbai. But while allowing an interim bail to Mr. Walke the court did following observations.

  • According to the court, Before arresting Walke the  Mumbai police did not serve him with the notice as required in the law.
  • The Mumbai police did not prove an alleged involvement of Walke into the liquor smuggling or adulteration.
  • Just because the applicant is dealing in liquor his involvement in the liquor smuggling or adulteration does not get established.
  • Court Allowed the Walke an Interim Bail and asked him to avail the regular bail from the court in Mumbai.    

According to Gitesh Walke, after getting an interim bail from Mapusa court Walke went to Mumbai in his own car along with his lawyer to apply for the regular bail, but to his surprise when he reached the court in Vashi, Mumbai he came to know that his harassment has not over yet. “I decided to go to Mumbai in my own car and took my lawyer along with me. But when we appeared in the court, we realized that the IO (Investigating Officer) did not come to the court. I realized that they have played this game to further harass me,” said Walke adding that, “The original copy of the interim bail was with the IO, and the court did not accept the copy showed to them on a mobile phone, and they gave me two days police custody.”

According to Walke, he does not have any involvement in smuggling or adulteration of the liquor and Mumbai police implicated him falsely into the case just to extort the money from him. After two days when the Mumbai court granted him the bail, He told the media that he will initiate a legal action against the concern police officers.

The Mumbai court while granting the bail to Walke did the following observations.

  • Mumbai police did an unlawful arrest of Walke by not serving him with the notice.
  • IO purposely delayed his appearance before the court to harass the applicant.
  • The IO has been served with the show cause notice by the court.                

Walke told the media that he will not remain silent over this issue, and will fight the legal battle with the corrupt officials of Mumbai police, who harassed him and implicated him wrongfully in the false case.

He told the media that if the police found his involvement or the link with the vehicle seized by them in Mumbai, then they could have contacted the Excise department or Goa police which they failed to do. Secondly, the IO had purposely kept the original copy of the bail with him and did not appear before the court.

“They only wanted to harass me by keeping me in police custody for two days, and that is why the IO did not appear before the court with the original bail papers. Besides this, they also made a false allegation in the Media about the sealing of my bank accounts. I am going to file the defamation case against the senior police officer of Mumbai police,” said Walke.

He also made a statement in the media that the Mumbai police is famous for doing such kind of harassments to extort the money from the people of Goa. “The Mumbai police try to harass me by way of implicating me falsely into the case, and by way of putting various sections. Their goal is only to take me to Mumbai and once I am stuck into the legal hassles, they wanted to extort more money,” said Walke adding that never cooperate with the Mumbai police, and instead get in touch with the local authorities and try to solve the issue with them.
