DANIELLE MCLAUGHLIN MURDER CASE – PUBLIC PROSECUTOR ASKS FOR DAY TO DAY HEARING BUT LAWYER OF ACCUSED DISAPPROVE

THE MOST CONTROVERSIAL CANACONA RAPE AND MURDER CASE IS STILL WAITING FOR THE LIGHT OF A JUSTICE. EARLIER, THE ACCUSED DENIED A FEE LEGAL ASSISTANCE AND OPTED FOR APPOINTING HIS OWN LAWYER TO HANDLE THE CASE. MEANWHILE, THE PUBLIC PROSECUTOR IS ARGUING FROM THE VICTIM’S SIDE. WHICH DIRECTION IS THIS CASE GOING? WILL THIS CASE ALSO RUN INTO THE SIMILAR FATE AS THAT OF THE DEVON TEENAGER SCARLETT KEELING?? LET’S TAKE A LOOK AT THE REPORT….

The report claims that Danielle was tortured before getting killed at the hands of culprits.  Her fully undressed body was found lying in the field near Devbag Beach, and the prime accused Vikat Bhagat, following his arrest confessed to the crime. In fact, he went one step ahead and told the police that he was not alone in the crime. This itself shows the amount of cruelty they might have done on the innocent soul.

Following her death, there was a huge outburst of a protest in Goa as well as in the UK where an Irish National Danielle McLaughlin actually belongs. Looking at the protest the police and government played safe by arresting the accused Bhagat. However, the accused who initially confessed to his crime started taking U Turn by changing his statements time to time. The accused also denied the free legal aid and finally engaged his own lawyer who is asking the court for the CCTV footage.

ACCUSED VIKAT BHAGAT WHILE TAKING INTO THE CUSTODY BY GOA POLICE

According to the sources, the public prosecutor who is appearing on the behalf of a deceased Daniell, in this case, had asked the court for a day to basis hearing of the trial. but, the lawyer of a prime accused Vikat Bhagat has objected to this. Advocate Arun Dsa who is appearing on the behalf of accused Vikat Bhagat has filed a written argument in the court objecting for the day to day hearing and asked for the CCTV footage of the Nest restaurant.

The sources have revealed that the court has directions from the CM of Goa, and Ministry of External Affairs to take the matter on fast track basis and hearing of the case should go on day to day basis. Based on the above, the public prosecutor Adv. V. Costa has made an application to the court asking for fast track trial of this case.

SPENDING THE TIME WITH FRIENDS DANIELLEMCLAUGHLIN

Meanwhile, according to the reports, the counsel of a accused had filed a written argument before the court and in his pleadings, he had put the light on certain important aspects of the case. According to Adv. Dsa, the investigation is still halfway as the police have not yet submitted the reports of mobile and other forensic records. In his written argument he brought to the notice of a court that in the absence of the above and CCTV footage report, the case cannot go ahead.

“If the court allows an application of a public prosecutor in the absence of the above, then we will have to argue the matter twice on the same issue which in will only lead to waste the court’s time,” he argued.

According to the sources, Adv. Dsa had filed an application asking for the copy of the CCTV footage of Nest restaurant in Canacona. The court had adjourned the matter for the submissions on 11th August.

It may be recalled that, on 13th March 2017, the body of a British national Danielle McLaughlin was found lying in a mysterious condition in the filed near Devbag beach in Canacona. The next day police arrested the prime accused Vikat Bhagat under section 302 for Murder, section 376 for Rape and section 201 for destroying of evidence. It is nearly six months, and the trial has not yet started despite the orders of CM’s office and External Affairs Ministry of India. What is your opinion? what will be the fate of this case?
